Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of This2That (the “Service”), a software tool that helps users transfer video files from Vimeo to Google Drive. The Service is operated by:

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of the Service

This2That is a one-time-purchase tool that enables users to transfer their video content from Vimeo to Google Drive. The Service offers two transfer modes:

  • Browser Mode: Transfers run inside your web browser using your local internet connection.
  • Server Mode: Transfers run on our servers, allowing you to close your browser while the transfer continues.

The Service is provided as a one-time payment per transfer capacity tier. There are no recurring subscriptions unless explicitly offered and agreed to.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement.

You must have valid accounts with both Vimeo and Google Drive, and you must have the legal right to access and transfer the content you wish to move.

4. Account Access and Authentication

The Service does not require you to create a separate account. Instead, you authenticate using OAuth with your existing Vimeo and Google Drive accounts.

You are responsible for maintaining the security of your Vimeo and Google Drive credentials. We do not store your passwords. OAuth tokens are held only for the duration necessary to complete your transfers and are deleted afterwards.

5. Your Content

You retain all rights to the videos and other content you transfer through the Service. We do not claim ownership of any content.

You are solely responsible for ensuring that you have the legal right to transfer the content. You must not use the Service to transfer content that infringes copyright, trademark, privacy rights, or any other rights of third parties.

The Service does not store your video content. Files are streamed directly from Vimeo to Google Drive through our infrastructure without being saved on our servers.

6. Pricing and Payment

The Service is offered through several one-time payment tiers. Current pricing is displayed on our website at the time of purchase. Prices are listed in US dollars and do not include applicable taxes, which may be added at checkout.

Payments are processed by Stripe, our payment provider. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

Each tier grants you a specific transfer capacity (in gigabytes or terabytes, depending on the tier). Once you reach your tier's capacity, you may upgrade to a higher tier and pay only the difference between your current tier and the new tier.

A free trial of up to 10 file transfers in Browser Mode is available without payment. The free trial is limited per Vimeo account and may not be reset.

7. Refunds

Because the Service provides immediate access to digital infrastructure and uses real resources for each transfer, all sales are generally final.

If you experience a technical issue that prevents you from using the Service as described, contact support@funmanagement.ro within 14 days of purchase. We will investigate and, at our discretion, provide a refund or credit if the issue cannot be resolved.

Refunds will not be issued for the following reasons:

  • You purchased the wrong tier and have already used a significant portion of the capacity.
  • Your transfers failed due to issues with Vimeo or Google Drive (rate limits, expired tokens, deleted videos, account suspensions).
  • You changed your mind after a successful transfer.
  • Slow transfer speeds in Browser Mode caused by your local internet connection.

8. Acceptable Use

You agree not to use the Service to:

  • Transfer content that you do not have the legal right to access or distribute.
  • Violate any law or regulation, including copyright, privacy, or export control laws.
  • Attempt to circumvent the capacity limits, free trial limits, or payment system.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated tools, bots, or scripts to interact with the Service in ways not intended by its design.
  • Interfere with or disrupt the Service or its underlying infrastructure.
  • Transfer content that contains malware, viruses, or other harmful code.

We reserve the right to suspend or terminate your access to the Service if you violate these Acceptable Use rules.

9. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, third-party outages (such as Vimeo or Google Drive APIs), or unforeseen technical issues.

We are not responsible for transfer failures caused by third-party services, including but not limited to changes to Vimeo's or Google Drive's APIs, rate limits, or terms of service.

10. Third-Party Services

The Service relies on third-party platforms, including Vimeo, Google Drive, and Stripe. Your use of these third-party services is governed by their own terms of service and privacy policies. We are not responsible for the actions, content, or policies of these third parties.

If Vimeo or Google Drive change their APIs or policies in a way that affects the Service, we will make reasonable efforts to adapt, but we cannot guarantee continued functionality.

11. Data and Privacy

We respect your privacy. The Service is designed to minimize data collection. Specifically:

  • We do not store your video content. Files stream directly from Vimeo to Google Drive.
  • OAuth tokens are temporarily held in encrypted form and deleted within 24 hours of transfer completion.
  • We collect your email address (via Stripe) for payment processing and customer support.
  • We log technical information necessary to operate the Service, such as transfer status, error messages, and usage statistics.

12. Intellectual Property

The Service, including its code, design, branding, and documentation, is the intellectual property of FUN MANAGEMENT SRL. You may not copy, modify, distribute, or create derivative works based on the Service without prior written permission.

The name “This2That” and any associated logos are trademarks of FUN MANAGEMENT SRL.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that all transfers will succeed. We do not warrant that the Service will meet your specific requirements.

You use the Service at your own risk. We strongly recommend verifying the integrity of your transferred files and maintaining backups of important content.

14. Limitation of Liability

To the maximum extent permitted by applicable law, FUN MANAGEMENT SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

In no event shall our total liability to you for all claims arising out of or related to the Service exceed the amount you paid to us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless FUN MANAGEMENT SRL, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Termination

You may stop using the Service at any time. There is no account to delete since the Service does not require account creation.

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we believe is harmful to the Service, other users, or third parties.

If we terminate your access for a violation, you are not entitled to a refund for any unused capacity.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a new “Last updated” date. Significant changes will be communicated via email if you have made a purchase.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively in the courts of Cluj-Napoca, Romania, except where applicable consumer protection law grants you the right to bring proceedings in your country of residence.

19. EU Consumer Rights

If you are a consumer residing in the European Union, you have certain rights under EU consumer protection law that cannot be waived by contract.

Right of withdrawal: Under EU law, consumers generally have a 14-day right to withdraw from a contract for digital services. However, by purchasing the Service and beginning a transfer, you expressly consent to the immediate provision of the digital service and acknowledge that you lose your right of withdrawal once the service has been performed.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and FUN MANAGEMENT SRL regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
